Welcome to The Victory Vibe! These Terms of Service outline the rules and expectations for using our website and purchasing products or services from us.

By visiting our website, placing an order, or purchasing from The Victory Vibe, you agree to these Terms of Service.

Our Shop

The Victory Vibe creates custom, personalized, made-to-order, and ready-to-purchase products for individuals, families, schools, teams, organizations, events, and businesses.

Because many of our products involve customization or small-batch production, some terms may differ from those of a traditional retail store. Product-specific information provided in an individual listing is considered part of these Terms.

Orders

By placing an order, you confirm that the information you provide is complete and accurate, including names, spelling, sizes, colors, quantities, personalization details, shipping information, and other selections.

We reserve the right to refuse, cancel, or limit an order when necessary, including in cases of suspected fraud, pricing or inventory errors, inappropriate or unlawful content, intellectual property concerns, production limitations, or other circumstances that prevent us from reasonably completing the order.

If we cancel an order after payment has been collected and production has not been completed, any applicable amount will be refunded.

Custom & Personalized Products

Customers are responsible for reviewing all personalization information carefully before submitting an order.

Products will be created based on the information submitted with the order or subsequently approved by the customer.

The Victory Vibe is not responsible for errors contained in information supplied or approved by the customer, including misspelled names, incorrect dates, incorrect sizes, incorrect colors, or other personalization choices.

Once production begins, custom or personalized orders generally cannot be changed, canceled, returned, or exchanged.

Design Proofs & Approvals

When a design proof is provided, it is the customer's responsibility to review the entire design before approval.

Approval confirms acceptance of the design, including spelling, wording, layout, personalization, and other visible details.

Once a proof has been approved and production begins, changes may require additional fees or may not be possible.

Minor differences between a digital proof and the finished product may occur because of materials, printing, engraving, cutting, manufacturing, or screen-display differences.

Customer-Provided Artwork, Logos & Content

When you provide us with a logo, image, photograph, phrase, design, trademark, school or team mark, or other content for use on a product, you confirm that you have the right or appropriate permission to use and reproduce that material for the requested purpose.

The Victory Vibe is not responsible for determining ownership or obtaining licensing rights for customer-provided materials.

We reserve the right to decline any project if we believe the requested content may violate intellectual property rights, applicable laws, platform requirements, or our business standards.

Handmade & Material Variations

Many Victory Vibe products are individually printed, engraved, cut, assembled, or finished.

Slight variations in placement, color, texture, engraving, wood grain, material, finish, or other characteristics may occur and are not necessarily considered defects.

Colors displayed on a computer, tablet, or phone may also differ slightly from the finished product.

Product Information

We work to provide accurate descriptions, photographs, measurements, pricing, and other product information.

However, occasional errors may occur. We reserve the right to correct errors, update information, change pricing, or cancel an order affected by an obvious pricing, description, inventory, or technical error.

Product availability may change without notice.

Pricing & Payment

Prices are displayed in U.S. dollars unless otherwise indicated.

Applicable taxes, shipping charges, customization fees, or other charges will be shown during checkout when applicable.

Payment must be successfully completed before an order is processed unless separate arrangements have been made in writing.

Production & Turnaround Times

Production and turnaround estimates are provided as a courtesy and may vary depending on order volume, product availability, customization, vendor delays, equipment issues, holidays, weather, or other circumstances outside our reasonable control.

If an item is needed for a specific event or date, please contact us before ordering when possible.

We cannot guarantee a specific delivery date unless that commitment has been expressly confirmed by The Victory Vibe.

Shipping & Delivery

Customers are responsible for providing a complete and accurate shipping address.

Once an order has been transferred to a shipping carrier, delivery timing may be affected by circumstances outside The Victory Vibe's control.

Additional shipping terms, including procedures for delayed, lost, or damaged packages, may be included in our Shipping Policy.

Returns & Refunds

Purchases are subject to our Return & Refund Policy.

Because many of our products are personalized, customized, made-to-order, or produced for specific events or organizations, some products are final sale.

Please review the Return & Refund Policy before placing your order.

School, Team & Organization Products

The availability of products featuring or referencing a school, team, club, organization, event, or community does not necessarily indicate sponsorship, endorsement, or official affiliation unless specifically stated.

When products are offered as part of an authorized fundraiser, partnership, spirit shop, or organization program, additional terms or ordering deadlines may apply and will be provided with the applicable collection or product.

Promotions & Discount Codes

Promotions, discount codes, special offers, and giveaways may be subject to additional conditions and expiration dates.

Unless otherwise stated, promotions cannot be combined, applied retroactively, or redeemed for cash.

We reserve the right to modify or discontinue promotions when necessary.

Website Use

You agree not to use our website, products, services, designs, photographs, or content for unlawful, fraudulent, abusive, or unauthorized purposes.

You may not reproduce, copy, sell, redistribute, or commercially use original Victory Vibe website content, photographs, graphics, product designs, or other creative materials without permission.

Intellectual Property 

Original designs, photographs, graphics, written content, branding, and other materials created by The Victory Vibe remain the property of The Victory Vibe unless otherwise agreed in writing.

Purchasing a physical product does not automatically transfer ownership of the underlying artwork, design files, graphics, templates, or other intellectual property used to create that product.

Limitation of Liability

To the extent permitted by law, The Victory Vibe will not be responsible for indirect, incidental, or consequential losses arising from the use or inability to use our products or website.

Nothing in these Terms is intended to limit rights or remedies that cannot legally be limited under applicable law.

Changes to These Terms

We may update these Terms of Service periodically to reflect changes to our products, services, business practices, or legal requirements.

The version posted on our website at the time of purchase will apply to that transaction unless otherwise required by law.
